TERMS & CONDITIONS

When purchasing a duvet, pillow or bed linen from Heavenly Feather Pty Ltd, Registration number 2022/539978/07 be sure to familiarise yourself with your Terms and Conditions.

1. PLACING AN ORDER
By placing an order with Heavenly Feather Pty Ltd and Starch Living and this website, you will be deemed to have read, understood, and agreed to these Terms & Conditions. Once you have placed an order, we will send you a confirmation that your order has been received. This is not a confirmation that your offer to purchase goods has been accepted. A contract between you and Heavenly Feather Pty Ltd and Starch Living for the sale of our products will only exist once an order has been accepted, paid for and dispatched to you.

Prices and availability of goods are subject to change without notice. A delivery charge will be added to your order value where appropriate.  Please see our shipping and returns policy. 

Dates quoted for delivery are estimated delivery dates only and may be subject to change. We cannot accept liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date of delivery.

2. CONFORMITY OF GOODS
We take every care to ensure that the description and specification of our products are correct. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products.

3. STOCK AVAILABILITY
We endeavour to display through this website all items in our current range. We aim to hold stock of all styles and sizes while a product is active. However, on occasion, an item may be out of stock. If this is the case, add the item to your wish list and we will notify you when it is in stock again.

4. CANCELLATION
Heavenly Feather Pty Ltd and Starch Living reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or if the goods ordered do not meet our quality standards. In this unlikely event, the purchaser will receive a full refund with no deductions.

5. PRICES
All prices quoted on this website are accurate at the time of publication, are quoted in South African Rands and are inclusive of South African sales tax (VAT) at the current rate.

6. RETURNS
Returns will attract a 25% handling fee.

7. GUARANTEE
Royal Comfort duvets and pillows have a two-year guarantee against faulty workmanship and material defects.

Payment for products purchased on this website may be made by electronic/Internet transfer into the following bank account:

9. CUSTOMER PRIVACY POLICY
Heavenly Feather Pty Ltd takes all reasonable steps to protect the personal information of users. For this clause, personal information shall be defined as detailed in the Promotion of Access to Information Act, No. 2 of 2000 (PAIA). The PAIA may be downloaded here.

10. MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa.

11. DISCLAIMER & LIMITATIONS OF LIABILITY
Heavenly Feather Pty Ltd and Starch Living does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents, directors, or employees or for any fraudulent misrepresentation. To the fullest extent permitted by law and save as provided above, neither Heavenly Feather Pty Ltd and Starch Living nor any other associated company shall be liable to you because of any representation, or any implied warranty, condition or other term, or any duty common law, or under the express terms of the contract, or in negligence (whether on the part of Heavenly Feather Pty Ltd and Starch Living or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.

While Heavenly Feather Pty Ltd and Starch Living uses reasonable actions to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness, and Heavenly Feather Pty Ltd and Starch Living will not be held responsible for any errors or omissions or for the results arising from the use of such information. While Heavenly Feather Pty Ltd and Starch Living takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

Heavenly Feather Pty Ltd and Starch Living will not be liable to you or be deemed to be in breach of these terms and conditions or any other contract with you because of any delay in performing, or any failure to perform, any of its obligations about the products ordered by you if the delay or failure was due to any cause beyond its reasonable control. Heavenly Feather Pty Ltd may assign or transfer any of its rights or subcontract any of its obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or subcontract any of your obligations under these terms and conditions except with the specific permission in writing of Heavenly Feather Pty Ltd.

The contents of these pages (including pictures, designs, logos, photographs, written text, and other material) are the copyright, trademark, or registered trademark of Heavenly Feather Pty Ltd and Starch Living. All rights reserved.

The copying, modification, distribution, reproduction or incorporation into any other work of part or all of the material available on this website, in any form, is prohibited.

13. COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and Heavenly Feather Pty Ltd and Starch Living chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 16 Desmond Street, Kramerville Johannesburg.

15. VARIATION
Heavenly Feather Pty Ltd may, in its sole discretion, change this agreement or any part thereof at any time without notice.

16. E and OE

Deliveries

A fee is charged for all deliveries, excluding click & collect. The customer will be charged for the cost of delivery, which will be reflected on the appropriate invoice in accordance with the prevailing Heavenly Feather Pty Ltd policy.

 11. Returns

Goods cannot be returned to Heavenly Feather Pty Ltd if:

  • After having been supplied to, or at the direction of, a customer, the goods have been partially or entirely disassembled, physically altered, permanently used, washed, attached, joined or added to, blended or combined with, or embedded within other goods or property;

  • The original invoice cannot be produced by the customer;

  • The goods have been damaged by the customer whilst in its care;

  • The original packaging has been removed and the goods are no longer in its original condition;

  • The goods are not in resale condition.

Heavenly Feather Pty Ltd will accept the return of goods in the following circumstances:

  • The original invoice is produced by the customer;

  • The return has been submitted by the customer via our website; 

  • The goods are returned in their original packaging;

  • Repackaged goods will be accepted by Heavenly Feather Pty Ltd  if they are in their original condition and only when it was necessary for the customer to remove such packaging in order to inspect conformity of the goods with a special order;

  • If goods that were delivered to the customer are incorrect, the customer must submit a request for a return of only those goods that do not conform to the order via our website;

  • The customer purchased goods or services via our website, then in that event the customer may cancel such transaction within seven (7) days of receipt of those goods, or of services within seven (7) days after the date of the conclusion of the agreement, and may receive a full refund, however Heavenly Feather Pty Ltd  will charge the customer for collection and transporting any goods to Heavenly Feather Pty Ltd and Starch Living; and

  • The goods or services were purchased as a result of direct marketing by Heavenly Feather Pty Ltd  to the customer, then in that event the customer may cancel such transaction by notice to Heavenly Feather Pty Ltd  in writing via our website, within five (5) business days after the transaction or agreement was concluded or the goods which were the subject of the transaction were delivered to. The customer may receive a full refund, provided you can establish that the transaction was as a result of direct marketing; and

  • The goods are defective or unsafe, and such defect or fault was present at the time of the conclusion of transaction and was discovered by the customer within the warranty period, then in that event the customer must submit photographs and a description of the defect together with your request for a return via our website, whereafter the goods will be assessed by Heavenly Feather Pty Ltd  and a return processed according to the terms referred to in the WARRANTY section above.

  • Wherever possible, Heavenly Feather Pty Ltd and Starch Living will repair or replace returned goods, and where not possible, Heavenly Feather Pty Ltd will credit a customer’s account with store credit.

  • If Heavenly Feather Pty Ltd and the customer exchange or substitute any goods previously delivered to the customer, from the date of delivery of the substituted goods, the transaction applies to the substituted goods rather than the goods described in the original transaction. 

Heavenly Feather Pty Ltd is entitled to charge the customer a reasonable amount for:

  • Use of the goods during the time the goods were in the customer’s possession, unless they are goods which are ordinarily consumed or depleted by use and no such consumption or depletion has occurred; or

  • For the necessary restoration costs to render the goods fit for restocking.
